3. WOOCOMMERCE ONLINE PLATFORM

Our store is hosted on a WooCommerce platform. They provide us with the online e-commerce functionality that allows us to sell our products and services to you.

Your data is stored through WooCommerce’s data storage, databases and the general WooCommerce application. They store your data on a secure server behind a firewall.

If you choose a direct payment gateway to complete your purchase, then WooCommerce stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

4. SALE OF BUSINESS

Accordingly, Karat cannot absolutely guarantee the accuracy, completeness or timeliness of the information provided on this site and expressly declines any liability from consequential damages that may result from the use of information posted on this site.

In compliance with industry standards and trade guidelines, diamond total carat weights may vary up to 0.05 carats on any Jewellery item. For gemstones, a tolerance of 0.50mm is allowed and, as gemstone cuts vary significantly, gemstone carat weights are approximate and may vary considerably from the stated approximate weight. In general, gemstone carat weights may exceed stated approximate weight.

2. Merchandise Displayed

Products displayed on our website as accurately as possible. Unfortunately, various factors, including the display and color capabilities of your computer monitor, may significantly affect what you actually see on your screen. We are not responsible for the display of any color, size, texture or detail of displayed merchandise on your computer screen and cannot guarantee the accuracy thereof. As each product photograph is taken individually, products have not been sized (re-sized) relative to other products displayed.

3. Merchandise Availability

We do not guarantee, represent or warrant that your use the Service will be uninterrupted, timely, secure or error-free. The availability of styles displayed on our website may vary from time to time. Some items may be available only in limited quantities or only until supplies last.

Each piece is hand made on order. We do our best to replace out of stock items and remove items that are no longer available (or are temporarily unavailable). We cannot guarantee that an item displayed on our website is currently in stock or that it will be available when you visit the website at a later date.

4. Gemstone Treatment Disclosure

We offer a large variety of colored gemstone items. We make every effort to adhere to best practice industry guidelines for gemstone treatment disclosure and follow practices set forth by the American Gem Trade Association (AGTA). As a general rule, almost all gemstones offered for sale are treated in some form prior to being used in the manufacture of jewellery.

5. Conflict Diamonds Disclosure

In compliance with the UN charter on the Kimberley Process, all diamonds used in our jewellery are purchased from sources that are not involved in funding conflict. Karat Imports supports all industry initiatives to end the trade in conflict diamonds.

6. Warranties

The products are sold on an “as is, where is” basis, and no warranty or condition or affirmation of fact, express or implied is made or authorized by Karat. Any and all representations and warranties, express or implied, legal, statutory, conventional or otherwise with respect to the products, whether pursuant to the Sale of Goods Act of any province or otherwise, are hereby expressly excluded and disclaimed.

In no case shall Karat, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility.

ONLINE STORE AND ORDER ACCEPTANCE POLICY

Our online store is built on a WooCommerce platform. This provides us with the online e-commerce functionality that allows us to sell our products and services to you.

You understand that your information (not including credit card information), may be transferred unencrypted and involve: (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Karat reserves the right at any time after receipt of your order to accept or decline your order for any reason. Karat further reserves the right any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. Your order will be deemed accepted by Karat upon our delivery of products or services that you have ordered.

Karat may require additional verifications or information before accepting any order. Notwithstanding the foregoing, you agree that, if Karat cancels all or a portion of your order or if Karat provides you less than the quantity you ordered, your sole and exclusive remedy is either that: (a) Karat will issue a credit by way of your original payment form, in the amount charged for the cancelled portion or the quantity not provided or (b) Karat will not process your payment for the cancelled portion of the order or the quantity not provided. Do not assume that a cancellation or change of an order you have placed with Karat has been effected until you receive a confirmation from Karat via email or the site.

You will be responsible for, and your credit card or third-party payment account may be charged for, the payment of all fees associated with orders already processed or shipped before your cancellation/change request or a request to terminate your account was received. Accepted orders exceeding item quantities or weights considered reasonable for normal personal use may be shipped by own arrangement via courier, or in person, from our distribution facility, with an agreed collection date and time. The product and condition thereof must be accepted and signed off prior to the shipment leaving our facility. PRICING

Karat reserves the right to show its pricing to only registered users of the Website.

All prices listed exclude applicable taxes, and shipping costs, and are in Canadian dollars and all delivery and any additional charges will be clearly displayed where they apply and will be processed in Canadian dollars. we are not responsible for the exchange rate at which a bank charges its customer, or for any additional charges it makes. In addition, any refunds are made in Canadian dollars and we are not responsible for the exchange rate at which a bank or credit card company charges its customer, or for any additional charges it makes.

Karat reserves the right to offer separately, exclusive pricing to its “Wholesale Clients”, meaning Trade Buyers (with bona fide credentials, a Store front and a Re-sale Tax ID) from all other clients “Retail Clients”. Karat will in our sole discretion determine the eligibility and classification of its Wholesale Clients. Retail Clients will not be eligible to receive the prices listed for Wholesale Clients.

All prices listed on this site are subject to confirmation and are subject to change without advance notice. If we discover price errors, they will be corrected on our systems, and the corrected price will apply to your order. Karat reserves the right to revoke any stated offer and to correct any errors, inaccuracies or omissions (including after an order has been submitted and accepted).
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

You agree to pay all charges payable for your order. We reserve the right to limit the quantity of items that you may buy. We also reserve the right to cancel orders at our discretion
